闪兵案成为社会最坏示范，新北地检署14日火速侦结，依涉嫌触犯「妨害兵役治罪条例」等罪嫌起诉12人，当中包括5名涉案艺人，均被求处2年8月有期徒刑。
新北地检署认为，修杰楷、陈柏霖、Energy谢坤达、Energy张书伟、棒棒堂小杰（本名：廖允杰）等5人为公众人物，享有高度媒体关注与名声所带来之社会红利，对青年世代具有相当影响力与示范作用，竟仍蓄意规避兵役，严重背离社会对公众人物之期待与公民应尽之责任，另考量其等法定役期均为1年10月，建请法院量处有期徒刑2年8月之刑。

然而坤达先前才传出有望回归「综艺玩很大」，三立电视台表示：「相信坤达在专心工作的同时，也能负起法律责任！节目单位绝对尊重司法调查程序！」连吴宗宪也希望坤达快点归队，相信他知错能改。
如今遭到起诉，为日后工作安排增添极大变数，对此，坤达经纪人回应：「深切反省，一切配合司法。」
